Taratibu za Kufanya Mabadiliko ya Matumizi ya Ardhi Tanzania

MABADILIKO YA MATUMIZI (VARIATION/CHANGE OF USE)

(fungu la 35 la Sheria ya Ardhi ya 1999)

 

1.0   UTANGULIZI;

Mabadiliko ya matumizi yanatokea pale ambapo mmiliki anapobadilisha masharti ya umiliki tofauti na yale aliyopangiwa awali. 

Mabadiliko haya ni kwa mujibu wa kifungu cha 35 cha Sheria ya Ardhi Na. 4 ya mwaka 1999.  Kwa upande mwingine, mabadiliko ya matumizi yanaweza kutokea pale ambapo kuna mabadiliko ya mpango wa mji (Replanning Scheme).



2.0 MAMBO MUHIMU YA KUZINGATIA KATIKA UTARATIBU WA KUBADILISHA MABADILIKO YA MATUMIZI

·      Maombi ya kubadili matumizi ya ardhi hupitia katika Halmashauri/Manispaa/Jiji husika kisha mapendekezo ya mabadiliko ya matumizi kuwasilishwa kwa Mkurugenzi wa Mpango wa Vijiji na Miji hutoa kibali cha kubadili matumizi baada ya kuridhia mapendekezo hayo.

·       Uhakiki wa eneo husika ufanyike ili kubaini hali halisi ya eneo husika kama inakidhi vigezo vya matumizi yanayoombwa.

·       Mkurugenzi wa mpango wa Vijiji wa Miji hutoa taarifa ya kibali cha mabadiliko ya matumizi kwa njia ya barua kwa Mkurugenzi wa Halmashauri/Manispaa/Jiji husika na nakala hupewa Kamishna wa Ardhi pamoja na mmiliki.


3.0 VIGEZO VYA KUZINGATIA WAKATI WA KUSHUGHULIKIA MABADILIKO YA MATUMIZI

·    Barua ya idhini ya mabadiliko ya matumizi kutoka kwa Mkurugenzi wa Mpango wa Vijiji na Miji.

·    Kupata makadirio mapya ya kodi ya ardhi toka kwa Mthamini Mkuu wa Serikali sambamba na mabadiliko ya matumizi mapya yaliyoidhinishwa.

·    Kuhakiki kama malipo ya kodi ya ardhi kwa mwaka husika wa fedha yamelipwa.

·    Baada ya ofisi kujiridhisha na vigezo vilivyoainishwa hapo juu humwandalia mmiliki fomu ya Maombi ya mabadiliko ya matumizi ambayo imeainishwa katika Kanuni ya Sheria ya Ardhi Na. 4 ya mwaka 2001, Fomu ya Ardhi Na. 27.  Fomu hiyo ni kama inavyoonekana hapa chini.

·       Sambamba na kusaini Fomu ya Ardhi Na. 27, mmiliki atatakiwa kufanya malipo yafuatayo:-


-      Ushuru wa Serikali kiasi inategemea mwaka wa fedha usika


-      Ada ya Usajili kiasi inategemea mwaka wa fedha usika.


-      Ada ya kibali kiasi inategemea mwaka wa fedha usika.

·       Mmiliki akishasaini fomu hiyo hutakiwa kuirejesha pamoja na viambatanisho vifuatavyo:

-      Hati milki halisi ya kiwanja husika.

-      Stakabadhi halisi za malipo ya kodi ya pango la ardhi kwa mwaka husika wa fedha pamoja na malipo ya ada zilizoainishwa.

·       Ofisi husika huandaa hati ya kibali cha mabadiliko ya matumizi ambayo husainiwa na mmiliki na kisha kusainiwa na Kamishna wa Ardhi/Afisa Ardhi Mteule, chini ya Kanuni za Sheria ya Ardhi Na. 4 ya mwaka 2001 Fomu ya Ardhi Na. 28.  Fomu hiyo ni kama inavyoonekana hapa chini.

·       Fomu hizo zinapokamilishwa huelekezwa ofisi ya Msajili wa Hati kwa ajili ya kusajili mabadiliko ya matumizi.
